Why SMS Was Never Going to Work for This Industry

SMS in the U.S. runs through a carrier-controlled approval and filtering system. Carriers scan message content in real time, and cannabis, THC, and related terms sit on the list of categories they block outright, alongside the other SHAFT categories like firearms and tobacco. Unlike firearms or alcohol, which can get approved with the right age-gating and registration, cannabis campaigns don’t have that path. The restriction isn’t about your compliance, it’s a blanket carrier policy that applies no matter what.

What This Doesn’t Change

We want to be direct about two things, because overselling this would set you up to get burned later.

Email still isn’t a free pass. Cannabis-related email faces its own, sharper version of spam filtering. Keywords like “THC,” “vape,” and “edible” get weighted more heavily by spam algorithms than equivalent language in other industries, and this is on top of the authentication requirements (SPF, DKIM, DMARC, sub-0.3% spam complaint rates) every bulk sender is dealing with in 2026. Clean list hygiene, honest opt-ins, and professional, value-first copy matter more here than almost anywhere else. We build campaigns with this in mind, but it’s worth knowing going in.

State law still applies. Telegram sidesteps carrier SMS restrictions. It does not sidestep the fact that THC and marijuana remain federally illegal and legal status varies significantly state by state. What’s compliant marketing in Colorado can be a real problem in a state where the product isn’t legal at all. This plan gives you a channel that isn’t blocked by carriers, it doesn’t give you a blanket green light to market however you want everywhere. Some even push you to rotate phone numbers every month, which is usually a sign that a previous number already got flagged and burned.

None of that protects you. Under carrier enforcement, a single flagged campaign of 10,000 messages can carry fines in the millions of dollars, and separately, TCPA violations run $500 to $1,500 per message, with liability falling on your business, not the platform that told you it was fine to send. A provider that gets your cannabis or THC campaign through carrier filters today isn’t protecting you, they’re setting up a bill you’ll eventually have to pay.
